RELATING TO HOMELESSNESS.
Requires the Hawaii Interagency Council on Homelessness, in conjunction with and with the advisement of the Department of Human Services and Department of Land and Natural Resources, to establish a working group to examine and develop recommendations related to the establishment of safe zones for persons experiencing homelessness. RELATING TO THE HOSPITAL SUSTAINABILITY PROGRAM.
Continues the Hospital Sustainability Program for two years. Increases the cap on the inpatient and outpatient hospital sustainability fees to not more than three and one-half percent of the hospital's net inpatient and outpatient service revenue, respectively. Appropriates $70,000,000 out of the Hospital Sustainability Program Special Fund for Fiscal Years 2017-2018 and 2018-2019. (HB89 CD1)

Extends the sunset date for the Coffee Berry Borer Pesticide Subsidy Program until June 30, 2021, for the purchase of pesticides containing Beauveria bassiana to combat the coffee berry borer. Provides that no single coffee grower shall receive more than $6,000 per year in subsidies between June 30, 2018, and July 1, 2021. (HB186 CD1)

RELATING TO LABOR.
Amends the requirements for a court to enjoin an employer who has not secured compensation coverage for employees. Authorizes the Department of Labor and Industrial Relations to issue an order of wage payment violation to the employer in violation of provisions regarding payment of wages and other compensation. Establishes penalties, enforcement, and appeal procedures related to orders of wage payment violations. (HB208 CD1)

RELATING TO TAXATION.

RELATING TO CANDIDATE COMMITTEE REPORTS.
Clarifies the due dates of preliminary, final, and supplemental reports of candidate committees to be submitted to the Campaign Spending Commission. Requires that a candidate who is elected and is sworn into office prior to thirty calendar days after a general, subsequent, subsequent special, or subsequent nonpartisan election file the final election period report three business days before the date the candidate is to be sworn into office. Requires that the supplemental report for candidate committees due on January 31 be filed annually. (HB280 CD1)

RELATING TO THE FAILURE TO FILE A REPORT WITH THE CAMPAIGN SPENDING COMMISSION.
Requires the Campaign Spending Commission to publish on its website the names of all candidate and noncandidate committees that fail to file a report or to correct a report within two weeks of the Commission's notice to correct. (HB281 CD1)

RELATING TO CONTINUOUS ALCOHOL MONITORING FOR REPEAT OFFENDERS.
Authorizing the fitting of a continuous alcohol monitoring device on persons charged for operating a vehicle under the influence of an intoxicant or habitually operating a vehicle under the influence of an intoxicant if the person: (1) Is a repeat intoxicated driver; or (2) Is currently awaiting a pending criminal investigation or prosecution for one or more prior charges of operating a vehicle under the influence of an intoxicant or habitually operating a vehicle under the influence of an intoxicant. Establishes a process for certain persons to receive financial relief for the cost of the monitoring devices. Requires the administrative director of the courts to submit a report to the legislature evaluating the effectiveness of the alcohol monitoring devices and any known effect on the ignition interlock devices. RELATING TO FILM AND DIGITAL MEDIA INDUSTRY DEVELOPMENT.
Amends the qualifications a production must meet in order to claim the credit. Caps the annual amount of tax credits that may be claimed at $35,000,000. Extends the sunset date to January 1, 2026. Requires DBEDT to submit an annual report to the Legislature regarding the activities and expenditures of the tax credit. Clarifies that no rule shall be adopted to expand the scope of the tax credit where the rule conflicts with legislative intent. Requires certain film productions claiming the tax credit to hire an independent third party certification of qualified production costs eligible for the credit. Requires DBEDT, in collaboration with DOTAX, to submit to the Governor and the Legislature a report on the number of jobs created in the State and the fiscal impact of every film production receiving the tax credit in the State. RELATING TO TECHNOLOGY TRANSFER AT THE UNIVERSITY OF HAWAII.
Makes certain sections of the Code of Ethics inapplicable to technology transfer activities sponsored by University of Hawaii if the activities comply with the regulatory framework and research compliance program approved by the Board of Regents. Requires the Board of Regents to submit written status reports to the Legislature every year. Repeals on June 30, 2022. (HB425 CD1)

Allows the John A. RELATING TO FIREARMS.

RELATING TO THE EMERGENCY AND BUDGET RESERVE FUND.
Prohibits the legislature from appropriating from the Emergency and Budget Reserve Fund: (1) more than 50% of the balance of the fund in a single fiscal year; (2) to expend for discretionary costs in a fiscal year, an amount that exceeds 10% of the total discretionary funds appropriated by the Legislature for the same fiscal year; and (3) for a succeeding fiscal year, unless the current fiscal year's tax collection is less than the collection for the previous fiscal year. RELATING TO MOVIE THEATRES.
Provides for the use of personal closed captioning systems as an alternative means of ensuring that closed captioning is provided by movie theatres with at least two locations. Clarifies the laws governing lobbyists by amending the definitions of "expenditure," "lobbyist," and "lobbying." Allows a former employer of a lobbyist to file a notice of termination of employment. Amends requirements for expenditure reports covering special sessions of the legislature. Requires the posting of lobbyist registration statements on the state ethics commission's website within a reasonable time after filing and the posting shall remain on the website for at least four years. Increases the maximum administrative fine from $500 to $1,000 for each violation of the lobbying law. (HB511 CD1)

RELATING TO PUBLIC LANDS.
Establishes a process for the re-leasing or renegotiation of a lease for public lands classified as commercial or industrial use near the end of the life of the lease. RELATING TO THE CAPITAL INFRASTRUCTURE TAX CREDIT.
Includes structures, machinery, equipment, and capital assets in the definition of capital infrastructure costs for the Capital Infrastructure Tax Credit. Sets cap on credit per taxable year per qualified infrastructure tenant including all partners and members of the qualified infrastructure tenant and its special purpose entities. Specifies that excess tax credits may be carried forward. Recaptures credit if qualified infrastructure tenant fails to relocate within a certain period of time after executing a lease with the Department of Transportation. RELATING TO THE STATE BUILDING CODES.
Requires the State Building Code Council to adopt codes or standards within two years of official publication, otherwise automatic adoption into Hawaii State Building Code will occur until such adoption is effectuated. Deletes requirement for Council adoption of new model building codes within 18 months of official publication date. Authorizes Council to receive private funds for code adoption. RELATING TO CONSUMER CREDIT REPORTING AGENCIES.
Requires a consumer credit reporting agency to create a record for protected consumers, including minors under the age of sixteen and incapacitated persons, who do not have an existing credit file. Permits a representative of a protected consumer to place a security freeze on the protected consumer's credit report or any record created for the protected consumer. Effective 1/1/2018. (SD1)

Appropriates funds to the Department of Land and Natural Resources to assist and provide supplemental funds to the National Wildlife Research Center of the U.S. Department of Agriculture to research the adverse effects of the rose-ringed parakeet on Kauai and develop and begin implementation of a control plan to reduce the negative impacts. Requires all child care providers to obtain and maintain liability insurance as a condition of licensure, temporary permission, or registration and disclosure of insurance-related information to certain parents or guardians. Provides exemptions from vehicle registration, safety inspection, and driver licensure requirements for tractor trucks, forklifts, and top picks being used as marine terminal equipment when operating on Sand Island Parkway and Sand Island Access Road between terminal locations under specific conditions. RELATING TO MOTOR VEHICLE RENTAL INDUSTRY.
Defines vehicle license recovery fees. Expands the base of government fees and taxes that a motor vehicle lessor may pass on to a lessee on a prorated basis to be the vehicle license recovery fees. Amends the prorated amount of vehicle license recovery fees that rental car companies may pass on to lessees. Requires all rental car companies to submit an annual audit to the Office of Consumer Affairs. Requires the motor vehicle rental industry to report to the legislature prior to the regular session of 2019. (HB735 CD1)

RELATING TO AGRICULTURE.
Repeals the requirement that the DOA must: (1) grant permission prior to the removal of eggs from any dock or landing; and (2) certify that eggs contained in a shipment are properly marked. Requires importation and other documents to be furnished to the DOA before imported eggs are offered for sale. Provides that a violation of section 147-75, Hawaii Revised Statutes, shall be considered an unfair and deceptive act or practice for which a person may bring an action. (HB775 HD2)

RELATING TO ENERGY AT THE UNIVERSITY OF HAWAII.
Establishes the University of Hawaii (UH) Green Special Fund to support energy efficiency, renewable energy, and sustainability projects and services, and planning, design, and implementation of sustainability projects for UH's benefit. Specifies that condominium boards may be in violation of fiduciary duty for violating the mediation and arbitration requirements of the condominium law. RELATING TO FORECLOSURES.
Makes permanent the affirmation requirement and form that is filed by an attorney on behalf of a mortgagee who is seeking to foreclose on a residential property under a judicial foreclosure action. Repeals the affirmation requirement of an attorney who files a complaint in a mortgage foreclosure action that would have been effective on 07/01/2017. (CD1)

RELATING TO AQUATIC LIFE.
Requires DLNR to submit proposed legislation to the legislature by the 2019 regular session including a definition of "sustainable", a policy for sustainable collection practices of near shore aquatic life, a process for determining limits on collection practices of near shore aquatic life, and any additional resources required by the department. Prohibits issuance of new aquarium permits. Prohibits transfer of current permits subject to certain provisions. Prohibits renewal of permits that have not been renewed for five or more years. (CD1)

RELATING TO AFFORDABLE HOUSING.
Authorizes qualified nonprofit housing trusts to repurchase affordable units developed with government assistance when a government entity waives its first right of refusal to repurchase the unit. Authorizes counties to waive a first right of refusal to repurchase a privately-developed affordable housing unit built pursuant to a unilateral agreement or similar instrument. (CD1)

RELATING TO SECURITY GUARDS.
Amends the process for registration, registration renewal, instruction, and training for security guards. Triennial registration period for security guards effective beginning on 6/30/2018. (CD1)

RELATING TO PRIVATE TRADE, VOCATIONAL, AND TECHNICAL SCHOOLS.
Clarifies the scope of the private trade, vocational, and technical school licensure program within the department of education. Establishes a licensing fee to ensure the sustainability of the licensure program. Establishes a license renewal process and fee. Creates the private trade, vocational, and technical school licensure special fund.
